What age do I have to be to get a lawyer?

You can usually have your own lawyer if you are 12 or over. Children as young as 8 can have their own lawyers. These are not strict rules. You will usually be able to instruct a solicitor as long as the solicitor thinks that you understand what a solicitor does and you understand the problem you need help with. This is called “having capacity to instruct a solicitor”. It will be up to the solicitor to decide whether or not you have capacity to instruct them.

Do I have to pay for a lawyer?

At Clan Childlaw we can give you free legal advice which means that you will not have to pay to get advice and help from our solicitors. We can sometimes provide free representation in court or hearings where legal aid is not available.
